On December 16th 2025, it was announced that the case of Ashley Walters (ex-assistant) brought against her former employer Marilyn Manson (Brian Warner) through her second amended complaint on March 11th 2022, has been dismissed without prejudice. This is because on September 19th 2025, Marilyn Manson and Marilyn Manson Records, Inc. filed a Motion for Summary Judgment, and this Motion was granted on December 16th. Hence the jury trial which was scheduled for the 26th of January will no longer take place. According to court documents, the Motion for Summary Judgment was granted for three reasons: 1. “There is no triable issue of material fact.” The court is saying: Even if we look at the evidence most favorably to the plaintiff, there is nothing a jury needs to decide because the key facts are either undisputed or legally irrelevant. Meaning: The dispute is purely legal, not factual — and the law favors the defendants. 2. “Plaintiff’s claims are time barred.” The court is saying:...
As previously reported, Marilyn Manson's attorney Howard King submitted on August 23rd a Motion to Strike 37 references to sexual assault of a minor from Bianca Allaine Kyne's Second Amended Complaint, and asked the court for her to submit a Third Amended Complaint.
On September 11th, Bianca's attorney Patrick Stoneking filed an opposition to Manson's Motion to Strike, stating that though the majority of the motions are inconsequential and Bianca has agreed to strike the majority of the references related to sexual assault of a minor, there are still a few references they are opposed to removing because it has bearing on her alleged assault when she was an adult in 1999. The first reference that Bianca refuses to have removed is related to what she believes was part of the grooming process that led to her being assaulted as an adult. And the second reference is related to behavior exhibited by Manson when Bianca was a minor that displayed a power dynamic which he later exploited when Bianca was an adult to abuse her.
In Exhibit 1 that accompanied the filing, the Second Amended Complaint is submitted with red marks to indicate what they intend to remove for the Third Amended Complaint.
We await the ruling as to what Motions to Strike submitted by Manson will be accepted or rejected.
Of further interest, this filing also confirms once again that Bianca filed a separate lawsuit against Manson on February 20th 2024 in Louisiana relating to the childhood sexual abuse (Kyne v. Warner et al., 2023-13429; A-16 - Orleans Parish).
